Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and TeachSimEHR ("Company," "we," "us," or "our") governing your access to and use of the TeachSimEHR platform, including any related services, features, and content (collectively, the "Service").
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.
Description of Service
TeachSimEHR is a clinical judgment simulation platform designed for nursing education. The Service provides:
- Interactive electronic health record (EHR) simulations
- Patient case creation and management tools
- Real-time student monitoring capabilities
- Quiz and assessment generation features
- Analytics and reporting tools
The Service is intended for use by nursing educators and their students in educational settings.
Account Registration
To access the Service, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or security breach
You must be at least 18 years old to create an account. By creating an account, you represent that you are at least 18 years of age.
Acceptable Use Policy
You agree to use the Service only for lawful educational purposes. You agree NOT to:
- Use the Service for any illegal or unauthorized purpose
- Share your account credentials with unauthorized users
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Upload malicious code, viruses, or harmful content
- Use the Service to harass, abuse, or harm others
- Reproduce, duplicate, copy, sell, or resell any portion of the Service
- Use automated systems or software to extract data from the Service
- Use patient simulation data for purposes other than education
- Misrepresent your affiliation with any person or entity
Violation of these terms may result in immediate termination of your account.
Subscription and Payment Terms
Subscription Plans
The Service is offered through subscription plans. Details of available plans, pricing, and features are displayed on our website at the time of purchase.
Free Trial
New subscribers may be eligible for a free trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.
Billing
- Subscriptions are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by law
- You authorize us to charge your payment method on file
- Prices are subject to change with 30 days notice
Cancellation
You may cancel your subscription at any time. Upon cancellation:
- You will retain access until the end of your current billing period
- No refunds will be issued for partial billing periods
- Your data may be retained in accordance with our Privacy Policy
Intellectual Property
Our Content
The Service and its original content, features, and functionality are owned by TeachSimEHR and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.
Your Content
You retain ownership of any patient cases, educational materials, or other content you create using the Service ("User Content"). By using the Service, you grant us a limited license to store, display, and process your User Content solely for the purpose of providing the Service to you.
Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation.
Student Data and FERPA
We understand the importance of protecting student information in educational settings:
- We are committed to supporting institutional compliance with FERPA
- Student data is used solely for educational purposes
- We do not sell or share student data with third parties for marketing
- Instructors maintain control over student data within their sessions

Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- Results obtained from the Service will be accurate or reliable
- The quality of the Service will meet your expectations
- Any errors in the Service will be corrected
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEACHSIMEHR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless TeachSimEHR and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your User Content
Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Non-payment of fees
- At our sole discretion
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on our website
- Updating the "Last updated" date
- Sending an email notification for significant changes
Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
